By signing, the Lessee agrees to this Rental Contract and the terms that follow, which form part of its Rental Agreement with Mainland Truck and Trailer Sales Ltd., and agrees that the equipment is inspected at pickup and at return and that taking the equipment means accepting it in good operating order, except as noted on the pickup inspection.
Rental Agreement
This Rental Contract is made under, and forms part of, the Rental Agreement between the Lessee and Mainland Truck and Trailer Sales Ltd. (the Lessor). If the Lessee has not signed a Rental Agreement, the Lessor's current Rental Agreement, published at mainlandtts.com/onboarding/rental-agreement/, applies to this rental. Words defined in the Rental Agreement have the same meaning here.
Term
The rental begins on the start date shown on this contract or, if earlier, when the equipment is released to the Lessee, and continues until the later of the end of the rental term and the date the equipment is returned to the Lessor.
Rent and charges
The Lessee shall pay, without demand and by the due date, the rent at the rates shown on this contract, the delivery or pickup charges shown, applicable taxes, and every other charge that becomes payable under the Rental Agreement. The obligation to pay is absolute and unconditional.
Pickup, delivery and inspection
The equipment is inspected at pickup and at return. Delivery, where shown, is made to the terminal or site on this contract at the charge quoted. By taking the equipment, the Lessee accepts it in good operating order, except as noted on the pickup inspection.
Use
The equipment may be used only in Canada and the United States, for lawful transportation purposes, by careful and sober drivers who hold a valid Class 1 driver's licence or its equivalent. The Lessee shall comply with all Applicable Laws, avoid abusive handling and excessive loads, and not mark the equipment with decals or advertising without the Lessor's written consent.
GPS and distance
Every rental unit is GPS-tracked, and distance is recorded by GPS for billing. If the GPS fails, the Lessee shall notify the Lessor within 12 hours or sooner, record the distance travelled manually and send those records to the Lessor daily. The charges in the Rental Agreement apply if it does not.
Care and maintenance
The Lessee shall inspect the equipment daily, maintain tire inflation, lubrication, brakes and lights in accordance with applicable regulations, keep it in the condition received, normal wear and tear excepted, and bring it in for inspection or repair when the Lessor asks.
Accidents and damage
The Lessee shall report any accident, damage, breakdown or loss to the Lessor within 12 hours, or as soon as it becomes aware of it, by calling 604-501-2233, the Lessor's 24/7 roadside help line for rental customers. The Lessee is responsible for loss of or damage to the equipment while it is in the Lessee's care, as set out in the Rental Agreement.
Insurance
The insurance required by the Rental Agreement must be in force from the start of the rental until the equipment is returned, with the Lessor named as additional insured and loss payee, and a current certificate of insurance must be on file before the equipment is released.
Tickets and violations
The Lessee is responsible for every ticket or violation arising during the rental and shall deal with it immediately. Unresolved amounts are charged with the penalty set out in the Rental Agreement.
Extensions and holdover
The Lessee shall request an extension before the expected return date if it needs the equipment longer. Continued use without an agreed extension is charged at the Lessor's standard rates, with possible penalties if the equipment was already committed to another customer.
Return
The Lessee shall return the equipment to the Lessor's yard at 9616 188 Street, Surrey, BC, unless this contract or the Lessor in writing names another return location, free of liens, in the condition received, normal wear and tear excepted, and cleaned to a rentable standard inside and out, free of debris and contaminants.
Default
If the Lessee fails to pay any amount when due or breaches this contract or the Rental Agreement, the Lessor may exercise the remedies in the Rental Agreement, including repossession of the equipment and recovery of its costs.
Ownership
The equipment remains the property of the Lessor at all times. This contract is a rental and not a sale. The Lessee shall not sublet the equipment or let anyone other than its own drivers or authorized agents use it.
Governing law
This contract is governed by the laws of British Columbia and the federal laws of Canada that apply there.
